These Terms and conditions apply to all products purchased from Byte-Wise IT Solutions or on bytewiseit.com.au. In using or accessing this website you acknowledge that you have read and understood and agree to be bound by these Terms and conditions. If you are not able to agree with any aspect of these Terms and conditions then please do not use the website.

1. By browsing/scanning and or submitting an order with us from this 'Online Store' you agree to be bound by these 'online store terms and conditions', the guide to online shopping, the bytewise.com.au site terms and conditions, any additional terms and conditions included in your order form or presented during the purchasing process and any other terms or conditions required to be implied by law (the "Conditions"). References in the bytewiseit.com.au site terms and conditions to "this site" include this online store.
2. This online store is operated by Byte-Wise IT Solutions :: A division of Bowen Byte-Wise Pty. Ltd. (ABN 35 707 373 527) ("Byte-Wise IT Solutions") and all purchases made through it are processed by Bowen Byte-Wise Pty Ltd Trading as Byte-Wise IT Solutions. Billing on the credit card statement will appear as "Byte-Wise IT Solutions".
3. Mobile voice and data services and handsets purchased under a Mobile payment plan ("MPP") through this online store are sold to you by Byte-Wise IT Solutions as agent for Vodafone Pty Ltd (ABN 98 225 422 941). Other handsets, accessories and devices are sold to you by Byte-Wise IT Solutions in its own right.
4. In these online store terms and conditions, references to "us", "we" and "our" refer to each of Bowen Byte-Wise Pty Ltd Trading as Byte-Wise IT Solutions, unless stated, or the context implies, otherwise.

Site contents, ownership and use restrictions
The material on this site is protected by copyright under the laws of Australia and other countries through international treaties. Unless otherwise indicated, all rights (including copyright) in all content, other material and compilations contained in, or used to create or support this site including text, graphics, logos, button icons, video images, audio clips and navigational and other software (collectively referred to as the contents) are owned or controlled, and are reserved by Byte-Wise IT Solutions and it's related companies, affiliates, licensors and licensees.

Byte-Wise IT Solutions operates this website from within Australia and the terms and conditions of use are governed by the laws of Queensland. By using this website, you agree to submit to Queensland law operating under the jurisdiction of the Queensland legal system, courts and tribunals.

Username and password
Once your username and password have been created you are responsible for their security and protection. If an unauthorised person uses your username and password then you are liable. It is the responsibility of the customer to protect and authorise the use of user names and passwords. Byte-Wise IT solutions will not take responsibility for customer user names and password protection. Both account and COD customers are liable to pay all monies outstanding from the purchase of goods on their account by any person that used their user name or password. You agree to release and indemnify Byte-Wise IT Solutions in connection with any use (whether authorised or unauthorised) of your user name or password. Byte-Wise IT Solutions may suspend or cancel your account at any time without prior notice.

Indemnity
You agree to indemnify and will keep Byte-Wise IT Solutions against any claim, demand, injury, damage, loss, expense, cost or liability (whether direct or indirect) made against or suffered by Byte-Wise IT Solutions in connection with your use of this site, your breach of these 'terms of use' or your breach of any rights of third parties.

Ordering
When you place an order through this website you have made an offer to purchase your selected items at the total price specified at the time of order. Orders will only be accepted from within Australia. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods being dispatched to you. To cancel an order you must send an email and only when a credit return authorisation number is issued will the order be deemed cancelled.

Purchasing and payment
When you place an order you must pay the applicable price for your relevant goods and the associated delivery and handling fees specified at the time of order. Freight charges are not refundable. Payment must be cleared before any goods are dispatched. All credit card details and personal information are encoded using Secure Sockets Layer (SSL) technology which is an encryption protocol that protects data as it travels over the internet.

To make a purchase through this online store on your own behalf:

1. you must be 18 years of age or over, or if you are under 18 years of age, you must have your parent or guardian's consent to make the purchase and enter into the terms and conditions applying to the purchase;
2. you must live in Australia;
3. delivery of the product(s) ordered must be to your address in Australia;
4. you must be authorised to use the credit card used to make your purchase; and
5. you must be buying for your own use and not for resale.

• the Entity must be located in Australia;
• delivery of the product(s) ordered must be to the Entity's address in Australia; and

For online orders we accept payment by Visa, MasterCard, direct debit, cheque or existing accounts. Customers are advised that our prices are updated daily, and are denoted on the website with the product. This is the final price at the time of purchase. We will not make a price adjustment should an order have already been shipped. Please note that promotional price may not be applied after an order is placed. To cancel an order you may call in, and send an email to ensure the transaction is documented. Please note that the order cannot be cancelled without credit return authorisation number. Shipping costs are not refundable. For each order, you must pay the applicable price for the relevant goods and the delivery and handling fee specified on the web site or as quoted.

Your order and credit card details are safe and secure. Bowen Bytewise IT uses SecurePay's internet payment service gateway to provide a secure environment for the authorisation of credit card transactions over the Internet. All personal and credit card information provided to Byte-Wise IT Solutions is also encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet.

Cancellations
Any attempt to cancel an order must be made as soon as possible. Cancellations cannot be attempted after goods have been despatched. Cancellations for undispatched orders will incur a 15% re-stocking fee.

Pictures and Images
Byte-Wise IT Solutions aims to include up-to-date pictures of all of the goods on this web site. However, our picture of the goods may differ from the actual goods. We recommend you read the labels on the goods carefully before using the goods.

Technical Assistance
Byte-Wise IT Solutions have no obligation to provide technical support or assistance for any products purchased from this site. Technical support, service or assistance may be charged at our current rate at the time of assistance is required.

Delivery
All orders placed on this site will be subject to confirmation and acceptance by Byte-Wise IT Solutions. We may require additional verification or information before accepting any order. Byte-Wise IT Solutions may vary prices at any time and provide reasonable notice. If we request payment for increased prices, you may cancel the order by giving notice to Byte-Wise IT Sloutions, which must be received within seven days of the announcement of the increase. The Byte-Wise IT Solutions or its supplier will deliver the goods you order to the address you specify in your order, within the agreed time frame, subject to their availability. Where the goods are not available we will notify you of this as soon as possible. Anyone at the delivery address who receives the goods will be presumed to be authorised to receive the goods. If there is no-one at the delivery address or no-one of appropriate age to receive and/or pay for the order, Byte-Wise IT Solutions may charge you additional delivery fees.

Delivery address and contact details
When placing an order with us, where we are to deliver goods to you, we require a physical street address. To assist us in processing your order, please provide your land-line phone number. Delivery is via courier and cannot be to a post office box. Please note that an authorised signatory needs to be at the delivery address to sign for and collect the goods, and that photo identification may be requested.

Termination
Your ability to purchase goods from this site may be terminated by Byte-Wise IT Solutions at any time without notice. All restrictions, licences granted by you and limitations of Byte-Wise IT Solutions liability will survive termination.

Changes to terms
Each order is governed by the Terms & Conditions current when the order is placed. Byte-Wise IT Solutions may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.
